Introduction

These terms and conditions govern the provision of Mandarin tutoring services provided by Mandarin Playtime ("Tutor") to you ("Student").

By booking a session, the Student agrees to these terms and conditions:

1. Tutoring Services

Mandarin Playtime will provide Mandarin language tutoring sessions (the "Services") as agreed upon between the Tutor and the Student.

Services:

• One-on-one tutoring

• Online Tutoring

• Online resources (within sessions)

• Learning consultation (before or after sessions) 

Frequency and Duration:

Sessions will be held weekly or bi-weekly (upon on the Student’s request) and will last approximately 45-50 minutes. Sessions will be charged for full hour as it includes preparation or session setup (10-15 mins) and one on one time (45-50 mins). For young learners, the one on one session may be ranged from 40 mins to 50 mins as the duration of the session depends on learner’s attention span.

Platform:

Sessions will be conducted in-person in public areas (i.e., library, university), or online platforms (i.e., Zoom, Skype, etc.) where both Tutor and Student agreed.

2. Attendance and Punctuality

The Student is expected to attend all scheduled sessions and arrive on time.

The Tutor will not be held accountable for accommodating students who arrive late for the session, and the session will conclude at the scheduled time as originally arranged.

In the case of online tutoring, students should ensure a stable internet connection and a quiet environment conducive to learning.

3. Scheduling, Rescheduling and Cancellations

Sessions are to be scheduled at the beginning of the service, our tutor will attend the tutoring session at appointed time/location with agreed frequency.

Students must notify the Tutor at least 48 hours in advance to cancel or 24 hours in advance to reschedule a session.

Cancellations or rescheduling requests made less than 24 hours in advance may be subject to a fee (cancellation fee, that is 25% - 50% of the session fee) or loss of the session, depending on the Tutor's discretion.

If the cancellation occurs:

• 48 hours before the scheduled session time, no fee will be charged;

• within 48 hours but greater than 24 hours before the session, 25% of the tutoring fee will be charged;

• within 24 hours but greater than 2 hours before the session, 50% of the tutoring fee will be charged;

• within 2 hours or the student has no show at the scheduled session time, the session will be charged fully.

• over 3 times, the Tutor reserves the right to issue a written notice to the student regarding the potential termination of services. The tutor may decide to terminate the service if there are three consecutive cancellations.

4. Homework and Assignments

The Tutor may provide homework or learning tasks to help advanced learners to learn better. Completion of homework or learning tasks are expected by the next tutoring session. Homework and extra practices are recommended but no compulsory for advanced learners, however incompletion of assigned tasks from the Tutor may delay the progress of learning.

Feedback will be provided on homework or learning tasks to facilitate improvement.

5. Progress Tracking

The Tutor will periodically assess the Student's progress and adjust the teaching plan accordingly.

Feedback with the Student (and parents, if applicable) will be arranged once every 4 sessions to discuss progress and/or any adjustments needed. Feedback or learning consultation may last 10-15 mins before or after the session. Any consultation that is over 15 minutes may be subject to a fee (learning consultation fee, which is $10 every 10 mins) in addition to the session fee.

6. Payment Terms

Payment for tutoring services is due in 7 days of the session’s completion.

Fees, payment methods, and schedules will be clearly communicated before the commencement of tutoring services.

Payment payable via online payment (from the invoice email, which will be charged 1.4% additionally) or bank transaction (details will be provided upon on request).

Late payments may result in a late fee (10% per day after 7 days from the completion of the session) and temporary suspension of services until resolved.

If the pricing guide has any change, Mandarin Playtime will communicate with our learners (and/or caregivers) 3 months before the change, learners/ caregivers can continue the service if agree with the new price guide, or terminate the service if otherwise.

7. Code of Conduct

Both Tutor and Student(s) agree to maintain a respectful and professional relationship.

Confidentiality regarding personal information and learning progress will be upheld by both parties.

8. Confidentiality

Both Tutor and Student agree to keep information related to tutoring sessions and any provided materials confidential.

To protect children’s confidentiality, Mandarin Playtime will only collect information details from the caregiver or parents (which includes name and contact details for receiving invoices).

9. Intellectual Property

Any materials provided during sessions are for personal use by the Student and may not be shared or reproduced without the Tutor's permission.

10. Limitation of Liability

The learner, or parent (or guardian) acknowledges and agrees that Mandarin Playtime is not liable for any damage, accidents, injury, loss, expense or liability that may occur to any person including students attending the premises.

The learner, or parent (or guardian) acknowledges and agrees that Mandarin Playtime's total liability for any claims is limited to the amount paid by the Student for the Services.

For young learners (children or young people that are under 18 years old), the liability rests with the caregiver or parents of the young person. Caregivers and parents are responsible in supervising and ensuring the safety of the children, even if they are in proximity during tutoring sessions. However, the Tutor may establish guidelines or expectations for caregivers’/ parents’ involvement during sessions to ensure a productive learning environment and may communicate any concerns about safety or behaviour to the caregivers as needed.

For adult learners, the liability rests with the learners (as known as ‘the Student’) themselves. Adult learners are responsible for their own actions, progress, and safety during tutoring sessions. The Tutor's role is to provide instruction, guidance, and support in learning the language, but not to held liable for the learner's outcomes or any consequences arising from the learner's actions. However, the Tutor may still have a duty to provide a safe learning environment and adhere to professional standards of conduct. The Tutor will communicate expectations clearly, address any safety concerns, and ensure that teaching methods are appropriate and effective for the learner's needs. If there are any issues or risks that may impact the learner's safety or well-being during sessions, the Tutor will address them promptly and take appropriate measures to mitigate any potential liabilities.

 11. Termination

Either party may terminate the agreement with written notice if terms and conditions are breached and not rectified within 14 days.

The Student and/or parents have rights to determine if they wish to continue receiving services from Mandarin Playtime. Learner and/or parents to give at least 14 days of written notice to communicate and/or negotiate if they wish to terminate the service from Mandarin Playtime.

Specific conditions under which termination is applicable should be stated, including lack of progress, repeated cancellations, or failure to pay fees.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with Australian Consumer Law (ACL), Privacy Act 1988, Australian taxation laws and Children and Young People (Safety) Act 2017.

13. Amendments

These terms and conditions may be amended by Mandarin Playtime with prior notice to the Student.

14. Acceptance

Booking a tutoring session constitutes acceptance of these terms and conditions.

Conclusion

Mandarin Playtime terms and conditions are designed to ensure a productive and respectful environment conducive to learning. Compliance with this policy is expected from all parties to achieve the best possible educational outcomes.
